Recruitment privacy notice

This recruitment privacy notice (hereinafter - Privacy Notice) sets out how Movavi Software Limited (hereinafter - Movavi, we, or us) handles your personal data when you apply for a job. Except as otherwise stated herein, Movavi is a data controller of personal data processed in accordance with this Privacy Notice.

When you apply for a job opening posted by us, this Privacy Notice will apply to our processing of your personal data in addition to our Privacy Policy.

Information we collect

The personal data we may collect from you includes:

  • contact details such as name, title, addresses, telephone numbers, and personal email addresses;
  • qualifications, such as professional qualifications, languages spoken, competencies and skills;
  • education and career history;
  • other information that you voluntarily decide to share with us, including in particular any other information which you disclose on a CV / resume.

Sensitive data. Please note that during the application process, under limited circumstances and to the extent permitted by applicable law, it may be necessary to process sensitive personal data, such as salary information, and the results of a pre-employment screening.

Use of information we collect

We use your personal data for the following purposes:

  • to consider your application with respect to the role for which you have applied, as well as for future roles that may become available;
  • to schedule and conduct (online) interviews;
  • to communicate with you with regard to the recruitment process;
  • to ensure compliance with legal requirements;
  • to protect our legal rights to the extent authorized or permitted by law.

Legal basis for processing:

  • our legitimate interest in recruiting staff for our business;
  • our performance of the contractual and precontractual measures relating to our potential employment relationship with you;
  • legal / statutory obligation. For example, the processing is necessary for the purposes of carrying out our obligations under applicable employment law; or
  • your voluntary explicit consent.

Disclosure of your information

We may disclose your information internally within our business to relevant teams including, without limitation, the human resources team, the hiring manager to whom the role reports, or the department within which the role is located.

We may also disclose your personal data to the following categories of recipients to the extent necessary:

  • Affiliates. We may share your personal data with other companies under common ownership or control with Movavi. These companies use your personal data as described in this Privacy Notice.
  • Business transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of a service to another provider, your personal data and other information may be transferred to a successor or affiliate as part of that transaction.
  • Service Providers. Some external service providers perform specific assignments for Movavi, such as suppliers for some of our HR systems and/or activities.
  • Compelled disclosure. We reserve the right to use or disclose your personal data if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process.
  • Others. We may share your personal data in other ways if you have asked us to do so or have given consent. For example, with your consent, we post testimonials that may identify you.

We only share your personal data with these parties if necessary. These parties must treat your data confidentially and must comply with applicable privacy regulations.

Security

Movavi stores your information and takes the appropriate administrative and technical security measures to protect that information from unauthorized access and disclosure in compliance with internal rules and procedures (including GDPR).

We maintain administrative and technical safeguards for the protection of your personal data. These safeguards include, without limitation, the following:

  • Administrative safeguards. Access to personal data is limited to authorized personnel who have a legitimate need to know based on their job descriptions. All such data is subject to password protection. In the case of third-party contractors who process personal information on our behalf, similar requirements are imposed.
  • Technical safeguards. Access to personal data in our database via the Internet is not permitted except through an encrypted virtual private network (VPN). Other access is limited to our physical premises, and the removal of personal data from our location is prohibited. Third-party contractors who process personal data on our behalf agree to provide similarly reasonable physical safeguards.

International transfer of your data

We collect information globally and may transfer, process, and store your information outside of your country of residence. Whenever we transfer your information, we take steps to protect it. To facilitate our global operations, we transfer information to and allow access to that information from countries in which companies owned or operated by Movavi have operations for the purposes described in this Privacy Notice. These countries may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located. When we transfer your personal data as described above, we will take all reasonable steps to ensure that your personal data receives adequate security protection where it is processed, and your rights continue to be protected pursuant to the applicable data protection law, including through the use of Standard Contractual Clauses approved by the European Commission. Your rights

Under data protection law, as the data subject, you have rights we need to make you aware of. The rights available to you depend on our reason for collecting and processing your information. 

  • Right of access. You have the right to request copies of your personal information. This right always applies. However, there are some exceptions when you may not always receive all of the information we process about you. 
  • Right to rectification. You have a right to ask us to correct or complete your personal information if you find that it is inaccurate or incomplete. If we share your personal information with others, we will ask them to correct or complete it as soon as possible.
  • Right to erasure. You may ask us to delete your personal data in certain circumstances, for example, if your personal data is no longer needed for the purpose for which it was provided or if you want to withdraw your consent. If we share your personal data with others, we will notify them that they need to erase your data where possible. 
  • Right to restriction of processing. You have the right to ask us to restrict the processing of your data in cases determined by law. 
  • Right to object to processing. You have the right to request that, under certain conditions, we restrict the processing of your personal data. 
  • Right to data portability. You have the right to request that, under certain conditions, we transfer the information that we have collected to another organization or directly to you. 
  • Right to withdraw consent. If we rely on your consent to process your personal data, you have the right to withdraw that consent at any time, but this will not affect any processing of your data that has already taken place.
  • Right to make a complaint to a supervisory authority. We maintain high standards when it comes to processing your personal data. If you have a concern about our privacy practices, including the way we handle your personal data, you can report it to the data protection authority authorized to hear those concerns. 
  • Right to non-discrimination. We will not discriminate against you for exercising any of the rights available to you.

Retention of personal information

If we collect your personal data, the length of time we retain it is determined by a number of factors, including the purpose for which we use that data and our obligations under applicable laws, but no longer than it is reasonably necessary in light of the purposes set out above. We may need your personal data to establish, bring, or defend legal claims. For this purpose, we retain your personal data for 7 years after the date it is no longer needed by us for any transactions, fulfilling contract purposes or communications.

Amendments

This Privacy Notice may be amended or canceled by us at our discretion without prior notification. A new version of the Privacy Notice is effective from the moment of its publication unless specified otherwise by such a new version of the Privacy Notice.
